Terms of Service

1. Acceptance of Terms

By accessing or using EnrichX402 ("Service"), operated by Merit Systems ("we," "us," or "our"), you agree to be bound by these Terms of Service. This includes any access via automated systems, AI agents, scripts, or direct API calls. Making any request to our endpoints constitutes acceptance of these terms, regardless of whether the request originates from a human user or an automated agent.

2. Service Description

EnrichX402 is an API aggregation service that provides access to third-party data enrichment, search, and research APIs. We act as a payment-enabled proxy, routing your requests to upstream providers and returning their responses. We do not generate the underlying data; we facilitate access to it.

3. Payment Terms

The Service uses the x402 HTTP payment protocol. All payments are made in USDC on the Base network (Chain ID: 8453).

  • Pricing: Each endpoint has a per-request price displayed via the x402 protocol. Prices may change without notice.
  • Finality: All blockchain transactions are final and non-refundable. Once a payment is confirmed on-chain, it cannot be reversed.
  • Failed Requests: If a request fails after payment due to upstream API errors, no refund will be issued. You assume the risk of third-party service availability.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You shall not:

  • Use data obtained through the Service to harass, stalk, or harm individuals
  • Violate any applicable laws, including data protection and privacy regulations
  • Resell or redistribute data in a manner that violates upstream provider terms
  • Attempt to circumvent payment requirements or exploit vulnerabilities in the Service
  • Use the Service for spam, phishing, or fraudulent activities

5. Data Accuracy and Third-Party Content

All data returned by the Service originates from third-party providers. We make no representations or warranties regarding the accuracy, completeness, or timeliness of this data. You are solely responsible for verifying any information before relying on it. Third-party data is subject to the respective provider's terms and conditions.

6. Intellectual Property

Data obtained through the Service remains the intellectual property of the respective third-party providers. Your use of such data is subject to their terms. You may not claim ownership of data retrieved through the Service or use it in ways that infringe on third-party rights.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MERIT SYSTEMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR USE OF THE SERVICE.

9. Indemnification

You agree to indemnify, defend, and hold harmless Merit Systems and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising out of or related to your use of the Service or violation of these Terms.

10. Modifications

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

11. Termination

We may suspend or terminate access to the Service at any time, for any reason, without notice. Since the Service operates on a per-request payment basis without accounts, termination may involve blocking specific wallet addresses or IP addresses.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Delaware.
